She said that prosecutors failed to prove the streets of the Satilla Shores subdivision where Arbery was killed were public roads, as stated in the indictment used to charge the men.

Defense Attorney Amy Lee Copeland says documents show that Glynn County officials declined to take over responsibility for the streets of Satilla Shores from a private developer when the subdivision was dedicated in 1958.

Arbery was killed Feb. 23, 2020, after he was spotting running in the Satilla Shores subdivision not far from his mother’s house.

Arbery, an avid jogger, was out for a run when the McMichaels and Bryan chased him in pickup trucks and then killed him in Satilla Shores, a neighborhood just outside of Brunswick, Ga., on Feb. 23, 2020.
