The Lord Advocate Dorothy Bain KC and her deputy Solicitor General Ruth Charteris KC are the Scottish government's principal legal advisors and members of the Scottish cabinet.

Solicitor general, Ruth Charteris KC, said the figures suggested some babies were dying in "high-risk" co-sleeping situations.

Ruth Charteris KC said that overall, safer sleep advice had worked to save the lives of thousands of babies but she was concerned by the findings which showed unsafe co-sleeping was still happening.

Solicitor general Ruth Charteris KC told the court: "The Crown's position is that mistakes were made during the trial."

Solicitor General Ruth Charteris KC, in a letter to Holyrood's criminal justice committee, confirmed Mr Whyte's lawyers had ceased the action and the case had been disposed of by the Court of Session last week.
